TERMS OF USE
- By using Fort Dox, you agree to be bound by the following Terms of Use.
- Fort Dox reserves the right to change/update the Terms of Use at anytime without notice. Using the Fort Dox website and application constitutes consent to the Terms of Use.

USAGE
- You are responsible for providing any information necessary for account registration and billing purposes. Misrepresentation of this information is forbidden and constitutes a breech of the Terms of Use.
- One person or entity may not maintain more than one free trial account. The trial accounts are limited in time and will be deactivated without warning after the free trial period. Documents and data stored in trial accounts will only be accessible post trial if the customer pays to continue the service. It is the customer's responsibility to remove all documents and data from the trial account prior to expiration if they are not interested in paying for the service upon expiration of the trial.
- You warrant that all documents and data stored in your Fort Dox account belong to you.
- You are responsible for all documents and data stored in your Fort Dox account even when documents are posted by others who have access to your account.
- You are responsible for maintaining the security of your account including login names and passwords. Fort Dox is not liable for any loss or damage resulting from your failure to comply with this security obligation.
- Fort Dox is housed in a Category 5 secured data center (NTT/Verio). Strictly monitored access using keycard protocols, biometric scanning protocols, and continuous interior and exterior surveillance, is limited to data center personnel only, without exception. Certified networking and security teams are trained to the highest industry standards and thoroughly experienced in managing and monitoring enterprise level networks. Fort Dox equipment and software is deployed in multiple redundant capacities and is tested and maintained to provide constant access for Fort Dox accounts. Our secure server software is the industry standard and one of the best solutions available today for secure e-commerce transactions. All of your personal information is encrypted so that it cannot be read as it travels across the Internet. Information is also mirrored on separate servers to avoid information loss and protection from disaster.
- You are responsible for backing-up your account using the backup feature provided with the Fort Dox software. Fort Dox is not liable for ANY loss of documents/data.
- Fort Dox may not be utilized for any illegal or unauthorized purpose. You must not violate any laws in your country, state, county, local area (including but not limited to copyright laws).
- Any violation in the Terms of Use will result in the termination of your account. This is the sole discretion of Fort Dox.
- Fort Dox does not warrant its application. The software is provided on an "As Is" and "As Available" basis.
PAYMENT
- You are obligated to pay for Fort Dox either monthly or annually. Payments must be made promptly via credit card. If payment is denied for any reason, Fort Dox reserves the right to suspend your Fort Dox account. All delinquent payments must be cured prior to Fort Dox restoring access to the account.
- All credit card transactions and sensitive information are encrypted and performed through a secure server protocol in order to safeguard the confidentiality of client data from unauthorized access, disclosure, loss, alteration or destruction.
- Fort Dox uses PayPal for all monetary transactions.

- Fort Dox is a pay-ahead service billed on a monthly/annual basis and is non-refundable. There will be no refunds or credits for partial months of service, upgrade/downgrade refunds, or refunds for months unused with an open account. Partial monthly/annual payment cancellations will not allow for prorated payment returns.
- Customers may request a paper invoice (net 30 days) only if they wish to pay annually for Fort Dox. Monthly service plans must be paid via credit card.
- Customers will receive a paper invoice (net 30 days) for license based Fort Dox software purchases. A signed Purchase Order is required for all license based pricing.
- You are responsible for updating your account billing and contact information if any change occurs.
- A valid credit card is required to activate your account after expiration of the free trial period.
- An upgrade from the free trial to a paying plan (monthly/annual) will end your free trial.
- Fort Dox will automatically adjust your pricing plan if you exceed your user id or storage capacity. The adjusted price will be billed to your credit card on the next billing cycle. If you wish to remain on your old pricing plan, you need to remove user ids and/or storage until you are within your previous plans stated parameters and contact Fort Dox.
- If you paid annually for Fort Dox and exceed your user ids and/or storage capacity, you will be billed the prorated difference for the rest of the 12 month period.
- If you pay for license based Fort Dox software and exceed your user ids, you will be billed the prorated difference for additional users and support fees.
- All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties, excluding only United States (federal or state) taxes.
- Fort Dox reserves the right to change pricing plans at anytime.
CANCELLATION
- You are solely responsible for properly canceling your account. You can do this within the software Account Settings option. You can cancel your account at anytime. You will receive an email or phone call to confirm your decision to cancel to prevent an error.
- Upon cancellation, your account will remain active for the remainder of your paid-through date.
- Upon cancellation, it is your responsibility to remove all of your documents from your account using the backup feature. If you do not remove the documents prior to your account expiring, you will be asked to pay for a month's service at the necessary pricing plan to reactivate your account, so you can perform the backup of your documents.
- Your account and the documents and data contained in your account will be deleted 30 days after your expiration date. We do not delete an account immediately to prevent documents and data from being deleted in error.
MODIFICATIONS
- Fort Dox reserves the right at any time to modify/discontinue, temporarily or permanently, Fort Dox services and/or products with or without notice.
- Fort Dox reserves the right at any time to modify/discontinue, temporarily or permanently, Fort Dox pricing plans with or without notice.
- Fort Dox shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the service.
INTELECTUAL PROPERTY
- The Fort Dox application is owned solely by Fort Dox. Any attempt to steal, copy, or distribute the Fort Dox application is unlawful.
- Fort Dox does not own or have rights to any customer's documents and data within their Fort Dox account. However, it is the customer's responsibility to provide payment to Fort Dox in order to access/download their documents and data. At anytime, a customer that has an active, paid account may download their data from the system and cancel the service.
- Fort Dox does not share or sell information collected from our application with any third party organizations.
- Fort Dox will only share information if necessary to investigate illegal activities, fraud, a breach of the Privacy Policy or Terms of Use, or when otherwise required by law.
GENERAL
- Your use of Fort Dox is at your sole risk. Fort Dox is provided on an "As Is" and "As Available" basis.
- Fort Dox does not warrant that:
1. Fort Dox will meet your specific requirements.
2. Fort Dox will be uninterrupted, timely, secure, or error-free.
3. The results that may be obtained from the use of Fort Dox will be accurate or reliable.
4. The quality of any products, services, information, or other material purchased or obtained by you through Fort Dox will meet your expectations.
5. Any errors in Fort Dox will be corrected.
- You expressly understand and agree that Fort Dox is not liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of use, documents/data, or other intangible losses (even if Fort Dox has been advised of the possibility of such damages), resulting from:
1. The use or the inability to use Fort Dox.
2. The cost/procurement of substitute products/services.
3. Unauthorized access to or alteration of your transmissions or data.
4. Any other matter relating to Fort Dox.
- Fort Dox support is available via e-mail and telephone for questions and assistance Monday to Friday between the hours of 8am to 5pm EST.
- Fort Dox gives information regarding accounts only to those employees who require it to fulfill customer service requests. Fort Dox does not provide account information to any other parties outside Fort Dox except for the billing information provided through PayPal.
- Fort Dox always reserves the right to refuse service, terminate accounts, and/or cancel orders in its discretion, including without limitation, to remove accounts that Fort Dox determines in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, or otherwise objectionable or violate any party's intellectual property or these Terms of Use.
- Verbal, physical, written, or other abuse (including threats of abuse or retribution) of any Fort Dox customer, employee, member, or officer will result in immediate account termination.
- You must not upload, post, host, or transmit unsolicited email, SMSs, or SPAM messages.
- You must not transmit any worms or viruses or any code of a destructive nature.
- If your bandwidth usage significantly exceeds the average bandwidth usage (as determined solely by Fort Dox) of other Fort Dox customers, Fort Dox reserves the right to immediately disable your account until you can reduce your bandwidth consumption or purchase additional service/licensing.
- The failure of Fort Dox to exercise or enforce any right or provision of the Terms of Use will not constitute a waiver of such right or provision. The Terms of Use constitute the entire agreement between you and Fort Dox and govern your use of Fort Dox, superseding any prior agreements between you and Fort Dox (including, but not limited to, any prior versions of the Terms of Use).
